Four months after the murder of DSP Surender Singh Bishnoi, Haryana Police failed to obtain the accused’s Test Identification Parade (TIP) from the scene of the crime. The court remanded the case for trial in Sessions Court on November 18.

After filing the challan, the police had filed a parade identification test (PIT) request of the six defendants, Sabbir alias Mittar, Ikram, Bhuru, Asru, Sabbir alias Baida and Abbas.

The court said that “reading the file shows that the indictment, in this case, has already been filed by the prosecution”. “The present request to carry out an identification test on parade filed by the prosecution is not admissible because the investigation has already been completed. Moreover, according to the objections of the defendants in the response that during the proceedings of the case, the defendants were presented in court without muffled faces and their identity has already been disclosed on several occasions,” the court explained.

“Therefore, the request to perform the test identification parade is without any merit, it is hereby dismissed,” the court added, in its order dated November 4. The police wanted the accused to be present at the scene of the crime identified by eyewitnesses. policemen.

Police filed charges against 12 defendants in the case on October 17. On July 19, Tauru DSP Surender Singh along with his player ASI Sanjay, EHC shooter Umesh Kumar and driver Constable Amit had gone to the hills of Pachgaon village. to stop illegal mining. A six-wheeled dump truck was seen loaded with rocks heading up the side of the hill. When the police chased the truck, it unloaded the equipment. There was no license plate on the back of the dumper. There were three to four men sitting inside the dump truck. Driver Mittar and cleaner Ikkar allegedly had a homemade gun and pointed it at the police and urged them to stay away or they would shoot them. Others seated inside the dumper allegedly said the police would issue a challan for illegal mining, so they needed to be taught a lesson to stop their vehicle.

As the driver of the dump truck increased the speed of the vehicle and tried to run over the group of police officers, the officers tried to save themselves. However, the driver drove the vehicle over the DSP, killing him instantly, the challan said. It was 11:50 a.m.

The forensic team recovered two cell phones, broken glasses, a blood soaked floor, two rocks, and shoulder insignia of three stars and HPS near the DSP’s body. Shortly after the murder, police arrested Ikkar, the dumper cleaner, allegedly after an encounter. Sabbir alias Mittar, the truck driver, was arrested on July 20. “The accused did not get out of the dumper. So how would three police officers identify them? Not getting a TIP in four months weakened the case,” said attorney Tahir Hussain Devla, representing the accused. Nuh SP Varun Singla did not answer the phone call.

UN-REDD is the program that works on reducing emissions from deforestation and forest degradation in developing countries and Akiko Inoguchi, who is Forestry Officer for Lao PDR and Viet Nam for FAO, also considers the repository a major asset. The Supreme Court observed that the technique of superposition of the skull for the identification of the corpse cannot be considered infallible.

When the overlay report is not supported by any other reliable medical evidence such as a DNA report or an autopsy report, it would be very risky to convict the accused on believing the identification of the victim’s corpse through the overlay test .the bench CJI UU Lalit and Bela M. Trivedi observed.

S. Kaleeswaran and John Anthonisamy@John along with the other three defendants were convicted by the trial court in a murder case. According to the prosecution, all of the defendants in connection with the plot hatched by them murdered a taxi driver, John Thomas. The Madras High Court rejected their appeals.

On appeal to the Apex Court, one of the arguments raised was that the identity of the dead body had also not been duly proven.

The bench noted that the body, when found, was in a highly decomposed condition and that the skeletal remains were found almost 5 months after the date of the incident of the missing deceased. Identification was therefore made by having the skull overlay test done by a forensic expert, the court noted.

“In Pattu Rajan v. State of Tamil Nadu4, this Court explained that although superimposed identification of the deceased is an acceptable piece of opinion evidence, courts generally do not rely on opinion evidence as only incriminating circumstances, given its fallibility, and the overlay technique cannot be considered infallible.In this case, since the overlay report was not supported by any other reliable medical evidence such as a DNA report or an autopsy report, it would be very risky to convict the accused believing the identification of the dead body of the victim by the overlay test. It is true that in the case based on circumstantial evidence, if the whole chain is duly proven by convincing evidence, the conviction could be registered even if the corpus is not found, but when according to the case of the prosecution, the body of the victim was discovered at the place indicated by the accused, it is imperative on the part of the prosecution to prove that the corpse or skeleton found at the request of the accused was indeed that of the victim and of no one else.”

Reassessing other evidence in the case, the panel found that the circumstances relied on by the prosecution did not complete the chain to dispel the assumption of innocence of the accused. The Court therefore acquitted them by quashing the concurrent conviction.

Both Coleman and Anderson are charged with negligence of a dependent resulting in death and obstruction of justice. Anderson will also be charged with murder. Coleman’s probable case affidavit states that she and Anderson are sisters.

Cairo’s body was found on April 16 in a field near Holder Road, a dead end road in southeastern Washington County. The young boy’s body was inside a hard-shell suitcase that had “Welcome to Fabulous Las Vegas, Nevada” printed on it.

“Why did you even have the nerve or the audacity to get rid of it like that?” said Mary Jane Jordan, Cairo’s great-grandmother. “I just want to know what happened. The baby didn’t deserve this. He was nice.

The probable cause affidavit says cell phone records place the phones belonging to Anderson and Coleman in the Holder Road area for 45 minutes – from 4:30 p.m. to 5:15 p.m. – on the afternoon of April 14, two days before the discovery of Cairo’s body in the suitcase. Video from a home surveillance system obtained by the ISP shows a car appearing at 4:53 p.m. on April 14 and stopping in the area where the suitcase was found.

On June 29, an ISP medical examiner was able to obtain a fingerprint match from two of the trash bags in the suitcase. These engravings belonged to Anderson. Nearly four weeks later, a second fingerprint match was made. this print has been identified as Coleman’s.

Huls said there was very little work for investigators at first because there were no witnesses, no family and the road is not busy. State police received thousands of tips on a hotline dedicated to the case, but Huls said none of the tips led to an association with the case.

Huls said there were no signs of trauma and Cairo’s death was linked to an electrolyte imbalance.

Coleman is being held in San Francisco. She should be sent back to Indiana within the next 30 days.

The Washington County community is thrilled that Cairo has been identified, but says they won’t be fully shut down until they get justice.

“He is still our angel. He always will be. Still. Yeah. We have the shirts and we wear them. And his birthday was a few days ago and he would be six years old. It’s really heartbreaking, but now we know,” said Washington County resident Yvonne Casey.

“Our prayers have been answered. We now know who he is, they have their suspect, they’re going to catch him. And then the rest of our prayers will be answered and he will finally get the justice he deserves,” said Janet Irk, another Washington County resident.
